Welcome to Paddle Monster. These Terms & Conditions ("Terms") govern your access to and use of paddlemonster.com and the Paddle Monster community hosted on Mighty Networks (together, the "Service"), operated by Paddle Monster, Inc., a company incorporated in the State of North Carolina, USA ("Paddle Monster," "we," "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Paddle Monster is a subscription-based online coaching community for paddlers, offering instructional content, training programs, and community access, hosted through the Mighty Networks platform. Paddle Monster is an independent business and is not affiliated with, owned by, or a subsidiary of Mighty Networks, Inc. Your use of the Mighty Networks platform is also subject to Mighty Networks' own Terms of Service and Privacy Policy.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create a Paddle Monster account. If you are located outside the United States, you are responsible for complying with your local laws in connection with your use of the Service.
3. Membership & Billing
- Paddle Monster memberships are billed on a recurring subscription basis (monthly or annually, as selected at signup).
- All payments are processed securely by Stripe. Paddle Monster does not collect or store your payment card information.
- You may cancel your membership at any time. Cancellation stops future billing; it does not automatically refund the current billing period.
- As a matter of policy, Paddle Monster does not guarantee refunds. That said, if you sign up by mistake or decide the membership isn't for you, contact us at info@paddlemonster.com and we'll generally issue a refund, no questions asked, at our discretion.
- We reserve the right to change subscription pricing with reasonable advance notice to active members.
4. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
5. Assumption of Risk — Physical Activity Disclaimer
Paddle Monster provides training programs, technique instruction, and coaching content related to stand-up paddling, canoe, and related paddle sports. Paddling and physical training involve inherent risks, including but not limited to drowning, physical injury, and death.
By using the Service, you acknowledge and agree that:
- You participate in any training, technique, or activity described in Paddle Monster content entirely at your own risk.
- Paddle Monster content is educational and general in nature, and is not a substitute for professional medical advice. Consult a physician before beginning any new training program, particularly if you have a pre-existing health condition.
- Paddle Monster, its coaches, and its owners are not liable for any injury, loss, or damage arising from your participation in paddling or training activities, to the fullest extent permitted by law.
- You are responsible for using appropriate safety equipment (including a PFD) and for assessing water, weather, and personal fitness conditions before any on-water activity.
6. Acceptable Use
You agree not to:
- Share your account access with non-members
- Post content that is unlawful, harassing, or infringes on others' rights
- Attempt to copy, resell, or redistribute Paddle Monster's paid content outside the community
- Use the Service in any way that disrupts or interferes with other members' experience
We reserve the right to suspend or terminate accounts that violate these Terms.
7. Intellectual Property
All training content, videos, articles, and materials provided through Paddle Monster are the property of Paddle Monster and its coaches, and are licensed to you for personal, non-commercial use as an active member only. You may not reproduce, distribute, or publicly share this content without our written permission.
8. Third-Party Platforms
Paddle Monster's community and billing functions rely on third-party platforms (Mighty Networks and Stripe). We are not responsible for outages, data handling practices, or policy changes made by these third-party providers, though we will make reasonable efforts to keep the Service running smoothly.
9. Limitation of Liability
To the fullest extent permitted by law, Paddle Monster and its owners, coaches, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to Paddle Monster in the twelve (12) months preceding the claim.
10. Termination
You may cancel your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, without refund for the remaining subscription period, except where prohibited by law.
11. Governing Law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in North Carolina, unless otherwise required by applicable consumer protection law in your jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
